General terms and conditions of business

Terms and Conditions (T&C) of Feinkosthaus Proscura GmbH

1. Scope and Conclusion of the Contract
These Terms and Conditions (T&C) apply to all business relationships between Feinkosthaus Proscura GmbH (hereinafter referred to as “Proscura”) and its customers. By placing an order for our products or services, you acknowledge these T&C in their version valid at the time of the order. Individual agreements must be made in writing.

2. Subject Matter and Scope of Services
Proscura offers products and services, the precise description and pricing of which are listed on the website or in the relevant contract documents. We reserve the right to make changes to the offerings if necessary for technical, legal, or economic reasons.

3. Prices and Payment Terms
All prices are final prices, including statutory VAT, unless otherwise stated. Payment can be made by bank transfer, credit card, or other payment methods offered by us. The invoice amount must be paid within 14 days of receipt of the invoice.

4. Delivery Terms and Transfer of Risk
Delivery takes place within the agreed timeframe to the address provided by the customer. The risk of loss or damage to the goods passes to the customer upon handover to the transport service provider.

5. Right of Withdrawal and Return Conditions
Customers have the right to withdraw from the contract within 14 days without stating reasons. To exercise the right of withdrawal, a written notification sent to our business address or by email is sufficient. Returns are at the customer’s expense unless the goods were defective.

6. Warranty and Liability
Proscura is liable only for damages caused by intent or gross negligence. For slight negligence, Proscura is liable only for breaches of essential contractual obligations and limited to foreseeable damage. Statutory warranty rights remain unaffected.

7. Data Protection
Your personal data is processed in accordance with our privacy policy and used solely for the fulfillment of the contractual relationship. Data will only be shared with third parties when necessary for contract execution.

8. Final Provisions
Should any provision of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. Amendments or additions to these T&C must be made in writing. The place of jurisdiction is the registered office of Proscura GmbH, provided this is legally permissible.
